Dear Sir/Madam,

In connection with consenting to sending a marketing offer and establishing commercial cooperation with MASFOOD Sp. z o. o. based in Mikołów (43-190), ul. Rybnicka 42 – in accordance with Art. 13 section 1 and section 2  Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter: “GDPR”), and Pursuant to the provisions of the Act of May 10, 2018 on the protection of personal data (Journal of Laws of 2018, item 1000), I inform you that:

1. Providing your personal data is voluntary, but necessary for the conclusion of the contract. Failure to provide your data will result in the inability to conclude and execute the contract.
2. The administrator of your personal data is MASFOOD Sp. z o.o. with its registered office in Mikołów (43-190), ul. Rybnicka 42 – registered in the National Court Register, maintained by the District Court in Katowice under KRS number 0000792784, NIP 6351851761, REGON 38374837400000. 3. Your personal data include the following categories of data:
   1. Customers and Contractors who are natural persons conducting business activity – first name and last name, place of business (exact address), PKD code, NIP, REGON, KRS number;
   2. Employees of Clients and Contractors: first name and last name, job position, place of employment, contact details (e-mail address, landline and work telephone).
4. Your personal data are processed for the purpose of:
   1. Conclusion and performance of the contract (Article 6, paragraph 1b of the GDPR);
   2. Fulfillment of legal obligations (Article 6, paragraph 1c of the GDPR), such as issuing and storing invoices, for the fulfillment of tax obligations, consideration of complaints;
   3. Fulfillment of legally justified interests of MASFOOD Sp. z o.o. (Article 6, paragraph 1f of the GDPR), such as, among others, determining, pursuing and enforcing claims, responding to your questions and complaints;
   4. Your personal data will be processed by MASFOOD Sp. z o.o. For the period necessary to perform the contract and after its termination for the period necessary for tax settlements and until the expiry of claims;
5. Your personal data may be transferred to:
   1. State authorities (e.g. Public Prosecutor’s Office, Police, President of the Personal Data Control Office, common courts);
   2. Partners acting on behalf of MASFOOD Sp. z o.o. (e.g. law firm, bank, transport and courier companies, postal operators);
   3. MASFOOD Sp. z o.o. does not intend to transfer your personal data outside the borders of the European Union, to international organizations;
   4. Your data is not subject to profiling.
6. MASFOOD Sp. z o.o. informs you about your rights:
   1. The right to access data, i.e. to obtain information about the purpose and method of processing your personal data and a copy of the data;
   2. The right to rectify data, i.e. to correct personal data if they are incorrect, have changed or have become outdated;
   3. The right to partial or complete deletion of data, the so-called “right to be forgotten”, i.e. to delete data unless there are legal obstacles;
   4. The right to limit data processing, i.e. to limit data processing only to their storage;
   5. The right to transfer data, i.e. to obtain your personal data that has been transferred to MASFOOD Sp. z o.o. or to indicate another administrator to whom MASFOOD Sp. z o.o. is to transfer the data, if technically possible.
   6. You have the right to withdraw your consent to the processing of your data at any time, provided that there are no legally justified obstacles. However, please remember that until you withdraw your consent, we have the right to process your personal data.
7. You have the right to lodge a complaint with the supervisory authority, which is the President of the Personal Data Protection Office, if you consider that the processing of personal data by MASFOOD Sp. z o.o. violates the provisions of the GDPR and other provisions regarding the protection of personal data.

We would like to assure you that MASFOOD Sp. z o.o. makes every effort to protect your personal data against accidental or intentional destruction, loss, alteration, unauthorized disclosure and use. For this purpose, appropriate measures have been implemented for the physical, organizational and technical protection of personal data.
